General Terms and Conditions

§ 1 Scope of Application

These General Terms and Conditions govern the use of the Streamlingo web application (hereinafter "Services") provided by Streamlingo GmbH, Ludwigsburger Str. 20, 76228 Karlsruhe (hereinafter "we" or "us"). By registering with Streamlingo, the user accepts these terms.

§ 2 Registration and Account Use

(1) Use of the Services requires registration. The user must provide a valid email address and a secure password.

(2) The Customer is responsible for maintaining the confidentiality of the login credentials and for all activities that occur under its user accounts. The Customer ensures that only persons authorized by it are granted access. Transferring the contract or a user account to a third party requires the consent of Streamlingo GmbH.

(3) The contracting party is the natural or legal person or public body specified during registration or ordering (the "Customer"). Where the Customer is an organization, user accounts are assigned to the persons it designates.

(4) Within the Customer's organization, a user account may be used by several authorized persons, including on multiple devices. Passing login credentials to third parties outside the Customer's organization, as well as subletting or reselling the Services, is not permitted.

(5) Each user account can host one event at a time. Parallel events therefore require a corresponding number of user accounts; these can be billed together on request.

§ 3 Services and Scope of Performance

(1) Streamlingo offers real-time translation services. The exact features, supported languages, and performance limits are detailed in the current service description on our website.

(2) The quality and accuracy of translations may vary. Streamlingo GmbH assumes no liability for translation errors. We reserve the right to modify, expand, or partially discontinue the offered Services at any time.

§ 4 Availability

The Services are designed to achieve high availability. However, scheduled maintenance or unforeseen outages may occur. Our responsibility is limited to the availability and functionality of our web interface. Disruptions caused by problems on the user's side (e.g., internet issues) are outside our responsibility.

§ 5 Rights of Use to Content

(1) The user receives the non-exclusive right, limited to the contractual purpose and duration, to use the translations and transcriptions created by the Services.

(2) Use that damages the reputation of Streamlingo GmbH is prohibited. When publishing translations, an appropriate reference to Streamlingo as the source must be included.

§ 6 Fees and Payment

The use of Streamlingo is subject to fees. Billing is based on the pricing structure displayed on the website or in the individual offer.

§ 7 Prohibited Activities

It is prohibited to use the Services for illegal activities or to take measures that impair the functionality or operation of the platform.

§ 8 Term and Termination

(1) The contract term is governed by the plan selected by the user.

(2) Monthly subscriptions may be terminated at any time. Termination takes effect at the end of the current billing period; access remains available until then, after which no further payment is collected.

(3) Annual subscriptions have a term of twelve months from the start of the contract. They may be terminated with effect from the end of the respective term and otherwise renew for a further twelve months each.

(4) Once termination takes effect, the account switches to usage-based billing. The usage relationship ends when the account is deleted, which the user can do at any time once no subscription is active.

(5) The right to extraordinary termination for good cause remains unaffected. Streamlingo GmbH reserves the right to suspend or terminate accounts in the event of significant violations of these Terms and Conditions.

(6) The deletion or return of personal data after termination is governed by the data processing agreement (§ 11).

§ 9 Liability

(1) Streamlingo GmbH is liable without limitation in cases of intent and gross negligence.

(2) In cases of slight negligence, we are only liable for breach of a material contractual obligation (cardinal obligation). In such cases, liability is limited to the foreseeable damage typical for this type of contract. For loss of data, we are only liable for the cost that would have been incurred for restoration if the user had performed regular and risk-appropriate data backups.

(3) Liability for indirect damages, in particular lost profits, is excluded.

§ 10 Intellectual Property and Rights to Content

(1) Ownership of the Services: The software, the "Streamlingo" trademark, and all related components are and remain the sole intellectual property of Streamlingo GmbH and are protected by copyright laws.

(2) License to Use the Services: Streamlingo GmbH grants the user a non-exclusive, non-transferable right, limited to the duration of the contractual relationship, to use the Services in accordance with the contract. The user is prohibited from copying, modifying, or reverse-engineering the software or parts thereof.

(3) Rights to User-Created Content: The rights to content created by the user using the Services (in particular the transcripts and translations as well as audio output generated from them) belong entirely to the user. To eliminate any doubt, Streamlingo GmbH hereby grants the user the exclusive, unlimited right in terms of time, territory, and content to use this created content for any purpose, in particular to reproduce, distribute, make publicly available (e.g., on podcast platforms), and edit it.

§ 11 Data Protection and Processing on Behalf of the Customer

(1) Streamlingo GmbH processes personal data in accordance with the Privacy Policy.

(2) Where Streamlingo GmbH processes personal data on behalf of the Customer, the data processing agreement under Art. 28 GDPR applies in addition. It forms part of this contract and is concluded by electronic consent in the customer portal. In the event of conflicts, its provisions take precedence over these Terms and Conditions.

(3) For church customers, the supplementary agreement on church data protection supervision under Sec. 30(5) of the EKD Data Protection Act applies in addition.

(4) The Customer is responsible for the lawfulness of the content it transmits, in particular for informing the participants of its events about the translation to the extent required.

§ 12 Final Provisions

(1) The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) The place of jurisdiction for all disputes arising from this contract shall be the registered office of Streamlingo GmbH in Karlsruhe, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.

(3) Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

Service Description

General Description

Streamlingo offers a real-time speech translation platform specifically designed for conferences and meetings. The platform allows you to customize language settings and facilitate multilingual communication in real time.

Features

AI-Powered Translation: You can choose to have your spoken content translated into pre-selected target languages using AI technologies. This feature processes spoken language in real time and outputs it in the translated language. Audio data is only stored permanently if an archiving or download feature is activated.

The following languages are currently supported: Afrikaans, Arabic, Armenian, Azerbaijani, Belarusian, Bosnian, Bulgarian, Catalan, Chinese, Croatian, Czech, Danish, Dutch, English, Estonian, Finnish, French, Galician, German, Greek, Hebrew, Hindi, Hungarian, Icelandic, Indonesian, Italian, Japanese, Kannada, Kazakh, Korean, Latvian, Lithuanian, Macedonian, Malay, Marathi, Maori, Nepali, Norwegian, Persian, Polish, Portuguese, Romanian, Russian, Serbian, Slovak, Slovenian, Spanish, Swahili, Swedish, Tagalog, Tamil, Thai, Turkish, Ukrainian, Urdu, Vietnamese, Welsh.

Supported languages may change depending on the state of technology.

Interpreter Support: For users who prefer a more personal and potentially more accurate translation, Streamlingo offers the option to use your own interpreters. The platform provides the technical infrastructure for interpreters to deliver their translations via audio transmission to the audience. This may result in slight delays.

Performance Limits and Notes

Delays: Due to the nature of speech recording and processing, slight delays in translation may occur. Incomplete sentences are held back until a complete sentence is captured, which may also cause brief delays.

Translation Quality: The quality of AI-powered translation may vary and depends on the clarity of the speech input and the complexity of the spoken content. Streamlingo GmbH assumes no liability for errors in translation.
